NOTICE OF CANCELLATION OF REGULAR ELECTION

 TOWN OF SAGUACHE 

As provided by Ordinance 86-1 and 86-1 Amended and Colorado law, the Town Clerk is authorized to cancel its regular election if the only matter before the voters is the election of persons to office and if, at the close of business on the nineteenth day before the election, there are not more candidates than offices to be filled at such election, including candidates filing affidavits of intent, and to declare the candidates elected.

After full review, the Town Clerk has determined that the conditions set forth in Ordinance 86-1 and 86-1 Amended have been met, and the regular election for the Town of Saguache scheduled for April 1, 2014 is hereby canceled, and the following candidates are hereby declared elected to the offices set beside their names:

 

          Tony Sandoval – (Mayor for a two-year term)

          May Engquist – (Trustee for a four-year term)

          Joel Johnson – (Trustee for a four-year term)

          Kate Vasha – (Trustee for a four-year term)

RESOLUTION NO. 2014-D

 

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF SAGUACHE, COLORADO CANCELING THE REGULAR ELECTION AND DECLARING THE CANDIDATES ELECTED

 

WHEREAS, Section 31-10-507, C.R.S., provides that if an ordinance has been duly adopted by a municipality requiring an affidavit of intent for write-in candidates pursuant to Section 31-10-306, C.R.S., the municipality may also provide that, if the only matter before the voters in an election is the election of persons to office and if at the close of business on the 19th day before the election there are not more candidates than offices to be filled at such election, including candidates filing affidavits of intent as write-in candidates, the Town Clerk, if instructed by resolution of the governing body, shall cancel the election and by resolution declare the candidates elected; and

WHEREAS, The Board of Trustees of the Town of Saguache has enacted Ordinance 86-1 in 1994.  Section 1 of said Ordinance requires that an affidavit of intent be filed for a write-in candidate at least twenty days prior to the day of election.  Section 2 provides that the election may be canceled if, at the close of business on the 19th day before the election there are not more candidates than offices to be filled at such election, including candidates who have filed affidavits of intent as write-in candidates; and  

WHEREAS, The Town Clerk has certified to the Board of Trustees that no affidavit of intent has been filed by any person as a write in candidate for the municipal election scheduled to be held on April 1, 2014, and that the number of candidates does not exceed the number of offices to be filled at said election. 

NOW THEREFORE, Be it resolved by the Board of Trustees of the Town of Saguache, Colorado, that the Town Clerk is hereby instructed to cancel the regular municipal election scheduled for April 1, 2014, providing no write-in candidates submit candidate affidavits by the end of day the 11th day of March 2014.

The Board of Trustees further resolves that candidates May Engquist, Joel Johnson and Kate Vasha are declared elected as Trustees of the Town of Saguache for a term of 4 years each and that candidate Tony Sandoval is declared Mayor for the Town of Saguache for a term of two years.  Pursuant to the provisions of Sections 1-1-202 and 31-4-401, C.R.S., the terms of office of said elected officials shall commence upon being sworn into office at the next regular meeting of the governing body after April 1, 2014. 

Pursuant to the provisions of Section 31-10-507, C.R.S., the Town Clerk is hereby instructed to publish notice of election cancellation in order to inform the electors of the municipality and to post such notice at each polling place and in not less than one other public place to meet the requirements of Section 31-10-507, C.R.S.
